  1. Agreement to Terms

By accessing or using the services provided by Premier Caregiving, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services. 

 

  1. Age Requirement & Authority
  • Minimum Age: You must be at least 18 years old to enter into service agreements. 
  • Legal Representation: If you are signing on behalf of a minor or incapacitated person, you represent that you have the legal authority (e.g., power of attorney or guardianship) to do so. 

 

  1. Services Provided

Premier Caregiving offers a range of non-medical care services, including but not limited to: 

  • In-home personal care and Activities of Daily Living (ADL) support. 
  • Companion care, meal preparation, and light housekeeping. 
  • Medication reminders and transportation assistance. 
  • Specialized care for Dementia, Alzheimer’s, and post-surgery recovery. 
  • Respite care for family members. 

Note: All services are subject to availability and professional assessments. 

 

  1. SMS Messaging Program

By opting into our SMS program, you consent to receive communications regarding your care. 

  • Message Content: Appointment reminders, caregiver arrival notifications, schedule changes, and health/safety alerts. 
  • Opt-Out: Text “STOP” to our shortcode at any time. You will receive a final confirmation text. 
  • Help: Reply “HELP” for assistance or email our support team. 
  • Rates: Standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages. 

 

  1. Client & Caregiver Responsibilities

To ensure the best quality of care, both parties must adhere to a professional code of conduct: 

  • Accuracy: Clients must provide complete medical history and care needs. 
  • Environment: Clients must maintain a safe, respectful, and harassment-free work environment for caregivers. 
  • Professionalism: Caregivers will maintain professional boundaries and follow established care plans. 
  1. Fees, Payments, and Cancellations
  • Rates: Service fees are based on the required level of care and will be communicated prior to the start of services. 
  • Payment: Due according to your specific service agreement. We reserve the right to suspend services for non-payment. 
  • Cancellations: We require at least 24 hours’ notice for cancellations. Late cancellations may incur a fee. 
  1. Service Limitations & Emergencies
  • Non-Medical: We do not provide skilled nursing, medical injections, or 24/7 constant medical monitoring. 
  • Emergencies: In a medical emergency, caregivers are trained to call 911. We are not liable for medical outcomes resulting from emergency situations. 

 

  1. Liability and Insurance

Premier Caregiving maintains General Liability, Professional Liability, and Workers’ Compensation insurance. 

  • Limit of Liability: Our total liability for any claim shall not exceed the amount paid for services during the three months preceding the claim. 
  • Property: We are not responsible for personal property damage unless caused by proven negligence. 

 

  1. Confidentiality (HIPAA)

All client information is handled in strict accordance with the Health Insurance Portability and Accountability Act (HIPAA). Please see our Privacy Policy for full details on how we protect your health data. 

  1. Termination of Services
  • By Client: You may terminate services at any time with appropriate notice. 
  • By Premier Caregiving: We may terminate services with 48 hours’ notice for non-payment or safety concerns. Immediate termination may occur if a caregiver’s safety is compromised.

  1. Governing Law

These Terms are governed by the laws of the state in which services are provided. If any provision is found invalid, the remaining terms stay in full effect.
